Nersa responds to Eskom’s Legal Challenge over Tariffs

The Energy Regulator approved Eskom’s allowable revenue of R206,380 billion for financial year 2019/20, R221,843bn for financial year 2020/21 and R233,078bn for financial year 2021/22. The approved allowable revenue will result in average percentage price increases of 9.41%, 8.10% and 5.22% respectively.

In performing its duties NERSA is guided by, amongst others, the Electricity Regulation Act, 2006 (Act No. 4 of 2006) and the regulatory framework. It remains confident that its determination is consistent with the governing legislative and regulatory requirements.

If Eskom is not satisfied with the decision, it is at liberty to invoke the National Energy Regulator Act, 2004 (Act No. 40 of 2004) which empowers any person to institute proceedings in the High Court for the judicial review of any decision of the Energy Regulator in accordance with the Promotion of Administrative Justice Act, 2000 (Act No. 3 of 2000).

The Decision and Reasons for Decision document as well as the detailed approved tariffs may be accessed on the NERSA website at www.nersa.org.za
